Terms and Conditions

Thank you for visiting www.kilohanaevents.com (the “Website”) owned and operated by Kilohana Events and Travel, LLC, an Arizona limited liability company (“we”, “us”, “our” or “Kilohana”).  By visiting our Website or by using any of our services or otherwise engaging in any transactions with us, you and all members of your traveling party (“you”, “user”, “traveler” or “client”) agree to be bound by the terms and conditions set forth below (the “Terms”). 

 

  1. Services. Kilohana provides certain travel advising services related to corporate travel, luxury travel with VIP services and perks, room blocks for group and destination travel, fully customized itinerary development and reservations, flexible independent travel, transportation, and travel insurance (collectively, the “Services”). The Services offered by Kilohana, including pricing, availability and specifications, may be modified by us from time to time in our sole discretion.
     

  2. Cost of Services. Depending on the type of Services rendered, we may require an upfront deposit for our Services.  Should your Services require this upfront payment, it will be collected at the time of your reservation. Our cost for Services are non-refundable. The obligation of Client to make payment to Kilohana according to these Terms is not conditioned on Client’s satisfaction with the proceeds of any Services under these Terms. Client understands and expressly agrees that delivery of the Services under these Terms shall obligate Client to make payment and payment shall not be withheld due to subjective dissatisfaction.
     

  3. Agent for Suppliers. Kilohana acts as an agent for certain service providers (such as hotels, car-rental companies, airlines, tour operators or other services providers) named in your itinerary or confirmation (“Suppliers”).  We are not owners or representatives of the Suppliers. We are not responsible for the acts or omissions of the Supplier or their failure to adhere to their own schedules, failure to provide services or refunds, or failure to honor obligations. You further acknowledge and agree that we are not responsible for any Supplier’s failure to comply with applicable law. You acknowledge that your travel arrangements may be affected or canceled by the Supplier, a government entity, or third party which we have no control over. You acknowledge that the Supplier’s own cancellation, rescheduling, rebooking and refund policies will govern your rights and remedies with respect to such Supplier, including any rights to receive a refund. 
     

  4. Supplier Rates. All pricing for Suppliers provided in a quote is subject to change until your reservation is confirmed and paid in full. You understand that discounted fares typically involve restrictions and that changing any aspect of your travel arrangements may result in the payment of additional money. You understand that airline tickets, air tours, or other products you may purchase are subject to supplemental price increases that may be imposed after the date of purchase by suppliers.  Post-purchase price increases may be applied due to additional costs imposed by a Supplier or government. You acknowledge that you may be charged other sums by us  to offset the increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets, or any combination thereof.  You  hereby consent to any post-purchase price increases and authorize us  to charge my credit card for such additional amounts.
     

  5. Risks of Travel. We assume no responsibility for and shall not be liable for the acts or omissions on the part of any third party not under our control or any acts of God, unsafe conditions, terrorism, warfare, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on “Find International travel Information” then click on “Country Information”, and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. For destination information specific to COVID-19, we recommend visiting IATA's COVID-tracking site in addition to the State Department site. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. Ultimately, it is your responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense. Additionally, you accept that Kilohana is not responsible for, nor will you  attempt to hold it liable for, any injury, damage, or loss you may suffer on account of any conditions, actions or omissions that are beyond our control.
     

  6. Traveler Responsibility and Passports. It is your sole responsibility to meet all travel requirements prior to your departure, including but not limited to obtaining passports, proper entry visas and medical vaccinations or other entry requirements of your destination and connecting points. Passports are required for all US Citizens traveling outside of the country including cruises. If you are traveling on a passport issued by a country other than the United States, it is your responsibility to confirm your passport validity and travel documents and requirements. MANY DESTINATIONS REQUIRE YOUR PASSPORT BE VALID AT LEAST 6 MONTHS AFTER YOUR RETURN TRAVEL DATE. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. If you have any questions regarding your passport or other travel documentation, please contact us.
     

  7. Credit Card Merchants and Payment Methods.
    a. We strongly recommend that clients pay for all travel by credit card as card companies provide the best possible form of consumer protection against the loss of funds due to supplier bankruptcy.  Clients who pay by cash, check or debit card have essentially no protection if services are not received or provided by the Supplier. Federal law may provide certain protections to credit card holders with regard to charges for services not provided. In the event a Supplier does not provide the services paid for, the credit card holder must dispute such charges, in writing and, in most instances, within 60 days of the purchase, in order to notify the credit card issuer that the services were not received. 

    b. Regardless of the payment method elected by clients, Kilohana will not be held financially responsible for the failure of a Supplier to provide in whole or in part their services, whether due to weather, terrorism, mechanical issues, warfare, careless actions, cessation of services or other unforeseen circumstances. To cover many of these issues that may prevent Suppliers from providing their services to you in whole, we strongly suggest you obtain travel insurance to help minimize potential losses.

    c. If a Supplier does not provide the service or ceases operations, your recourse is against the Supplier, not us. You agree not to dispute the credit card charges processed by us. You agree not to initiate a chargeback against us or a refund request that is not authorized by these Terms and to pay any and all legal fees incurred by us in disputing any such claim for refund, and any attempt to do so will constitute a breach of these Terms.
     

  8. Travel Insurance. We strongly recommend clients purchase travel insurance to help protect your investment, and you understand that you may purchase travel insurance to cover certain risks inherent in travel, such as supplier bankruptcy and the inability to travel due to a medical or personal emergency. If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Consult the insurance carriers directly for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage. No representation or description of the insurance made by us constitutes a binding assurance or promise about the insurance. You agree to hold us  harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy. If you elect not to obtain travel insurance, you must have notified us of such election prior to us releasing any documents.
     

  9. Proof of Identity.
    a. IMPORTANT INFORMATION FOR DOMESTIC AIR TRAVELERS: You understand that the Transportation Security Administration (TSA) required you to carry a government-issued identification card in order to board a flight.  You have been advised that the name, date of birth, and gender that appears on the identification card must exactly match the same data that is listed on your airline ticket and in your booking records. You acknowledge that any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss flights.

    b. All travelers must present accepted photo identification such as a passport or other state or government--issued photo. The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards.  Beginning on May 7, 2025, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport.  To avoid disruption to their travel plans, air travelers are strongly encouraged to consult with the Department of Homeland Security (www.dhs.gov/real-id) to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.
     

  10. Price Increases. Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. 
     

  11. Limitation of Liability for Air Transport. IN ADDITION TO THE LIMITATIONS OF LIABILITY SET FORTH BELOW, YOU AGREE THAT WE ARE NOT LIABLE  FOR ANY DAMAGES ARISING FROM OR RELATED TO ANY AIRLINE TIMETABLE CHANGES, DELAYS, CANCELLATIONS, MISSED CONNECTIONS, MECHANICAL PROBLEMS, INCLEMENT WEATHER, SEATING REASSIGNMENTS, LOST/DELAYED BAGGAGE, SCREENING AND SECURITY DELAYS, REFUSED BOARDING OR FAILURE TO CHECK-IN PROPERLY.
     

  12. Cancellation and Refund Policy. Please be aware that most travel bookings are non-refundable and canceled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for the amount of that fee or charge; We reserve the right to charge processing fees in the event of refunds, cancellations and other services. To change or cancel your flight itinerary, you must do so prior to originally scheduled departure. No value remains after departure. If you are holding guaranteed hotel or car reservations you wish to cancel, you must contact the vendor directly adhering to their cancellation policy. We are not responsible to pay you for any loss you incur due to your failure to travel or your failure to follow the change or cancel policies of any travel vendor.
     

  13. Supplier Bankruptcies. If an airline or other Supplier declares bankruptcy, it is not obligated to honor your reservation made before bankruptcy or to refund tickets issued before the bankruptcy.  Travel agents are not allowed to refund tickets on airlines which have declared bankruptcy. Money given to a travel agent immediately becomes the property of the airlines, and we are required by laws to comply with airlines' orders. If an airline declares bankruptcy, it might continue service, limit service, or stop completely.   Other airlines might accept travelers under limited circumstances or may refuse to accept any travelers from the defaulted carrier.   Meanwhile there are fine travel insurance plans available for travelers to protect themselves in case of airline bankruptcies.
     

  14. LIMITATION OF LIABILITY. WITHOUT LIMITATION, CLIENTS ASSUME THE RISK OF, AND AGREE THAT WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO ANY ACT OF GOD OR PUBLIC ENEMIES, ARREST, RESTRAINTS OF ANY GOVERNMENT OR RULERS OF PEOPLE, PIRACY, WAR, REVOLUTION, EXTORTION, TERRORIST ACTIVITY, THREATENED OR ACTUAL REBELLION, POLITICAL UPHEAVAL, CIVIL UNREST, RIOTS, FIRE, LOCKOUTS, EXPLOSION, COLLISION, WEATHER CONDITIONS, DANGERS INCIDENT TO THE SEA, MECHANICAL OR CONSTRUCTION FAILURES OR DIFFICULTIES, DISEASES, LOCAL LAWS, ABNORMAL CONDITIONS OR DEVELOPMENTS, CLOSURE OF AIRPORTS/SEAPORTS/HOTELS/TRAIN STATIONS, CARRIER OR SUPPLIER LOGISTICAL PROBLEMS, COMPUTER PROBLEMS STRANDING, FOOD OR WATER POISONING, ILLNESS, GROUNDING, PERILS OF THE SEA, RIVERS, CANALS, LOCKS OR OTHER WATERS, PERILS OF NAVIGATION OF ANY KIND, THEFT, ACCIDENT TO OR FROM MACHINERY, BOILERS, OR LATENT DEFECTS EVEN THOUGH EXISTING AT THE COMMENCEMENT OF THE TRIP, DESERTION OR REVOLT OF CREW, OR LOST/DAMAGED/DELAYED LUGGAGE. IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED. OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE SERVICES YOU PURCHASED FROM US, NOT INCLUDING ANY AMOUNTS PAID WHICH ARE OWED TO ANY SUPPLIERS OR PARTNERS.
     

  15. Choice of Law. These Terms shall be governed by the laws of the State of Arizona without regard to its conflicts of law provisions. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be fully severable, and these Terms shall be construed and enforced as if such provision had never comprised a part of these Terms. 
     

  16. Dispute Resolution. In the unlikely event of a dispute arising from or relating to these Terms, the dispute shall be settled by binding arbitration in Arizona, which will occur via telephone by an arbitrator that is mutually approved by the parties. The costs of the arbitration will be shared equally by the parties; provided, that the prevailing party will be entitled to reimbursement by the other party of its reasonable costs and expenses incurred therein, including its reasonable attorneys’ fees and costs. 
     

  17. Changes to these Terms. We reserve the right, in our sole discretion, to change these Terms. We may amend or terminate these Terms at any time. If we amend or terminate these Terms, such amendment or termination shall be the revised Terms on this Website and such revised Terms will be effective at the date we post them on the Website. Each time you use the Website, you should visit and review the then current Terms. Your continued use of the Website and/or Services after we have posted revised Terms signifies your acceptance of such revised Terms.
